Lenders traditionally have taken steps to ensure that real property offered as collateral is not affected by the presence of hazardous materials. Environmental risks must be identified prior to funding of the loan, and environmental risks must be re-examined prior to foreclosing on the real property. In November 2006, the EPA adopted new regulations that require buyers of real property to show that the buyer made “all appropriate inquiries” with respect to the environmental condition of the real property. This requires more than just a Phase I audit. Although EPA regulations generally exempt the lender from cleanup costs, can the borrower afford to pay for the cleanup costs? And, if the loan goes into default, will the lender want to take ownership of the real property? The FDIC recently issued Guidelines for Environmental Risk Program to address these new EPA regulations.
